Scope of Work:

Level 1 - Ms. Clark becomes counsel of record for client; personally meets with client; assesses police stop and constitutionality thereof; makes herself available to address all of client’s questions and concerns; assesses such issues as refusal to blow, field sobriety exercises (horizontal gaze nystagmus, walk and turn, one leg stand), 2255 documentation, breathalyzer examination and related components; reviews client’s history; researches applicable statutes; analyzes accompanying alleged ordinance violations; and based on her overall case assessment, negotiates the best possible plea arrangement for Client at initial court appearance.


Level 2 - Ms. Clark becomes counsel of record for client; personally meets with client; assesses police stop and constitutionality thereof; makes herself available to address all of client’s questions and concerns; assesses such issues as refusal to blow, field sobriety exercises (horizontal gaze nystagmus, walk and turn, one leg stand), 2255 documentation; breathalyzer examination and related components; reviews client’s history; researches applicable statutes; analyzes accompanying alleged ordinance violations; drafts and files with the Municipal Clerk of Courts a Motion for Discovery demanding prosecutorial evidence; once obtained, reviews all of that evidence with client; based on her overall case assessment, Ms. Clark negotiates the best possible plea arrangement for Client within two to three court appearances.


Level 3 - Ms. Clark becomes counsel of record for client; personally meets with client; assesses police stop and constitutionality thereof; makes herself available to address all of client’s questions and concerns; assesses such issues as refusal to blow, field sobriety exercises (horizontal gaze nystagmus, walk and turn, one leg stand), 2255 documentation; breathalyzer examination and related components; reviews client’s history; researches applicable statutes; analyzes accompanying alleged ordinance violations; drafts and files with the Municipal Clerk of Courts a Motion for Discovery demanding prosecutorial evidence; obtains applicable Certifications (FST, Intoxilyzer 5000, Solution) from law enforcement; once obtained, reviews all of this evidence with client; based on her overall case assessment, Ms. Clark negotiates the best possible plea arrangement for Client.


Level 4 - Ms. Clark becomes counsel of record for client; personally meets with client; assesses police stop and constitutionality thereof; makes herself available to address all of client’s questions and concerns; assesses such issues as refusal to blow, field sobriety exercises (horizontal gaze nystagmus, walk and turn, one leg stand), 2255 documentation; breathalyzer examination and related components; reviews client’s history; researches applicable statutes; analyzes accompanying alleged ordinance violations; drafts and files with the Municipal Clerk of Courts a Motion for Discovery demanding prosecutorial evidence; obtains applicable Certifications (FST, Intoxilyzer 5000, Solution) from law enforcement; once obtained, reviews all of this evidence with client; conducts research and drafts Motion(s) to Suppress Evidence and/or In Limine, and Ms. Clark negotiates the best possible plea arrangement for Client.


Level 5- Ms. Clark becomes counsel of record for client; personally meets with client; assesses police stop and constitutionality thereof; makes herself available to address all of client’s questions and concerns; assesses such issues as refusal to blow, field sobriety exercises (horizontal gaze nystagmus, walk and turn, one leg stand), 2255 documentation; breathalyzer examination and related components; reviews client’s history; researches applicable statutes; analyzes accompanying alleged ordinance violations; drafts and files with the Municipal Clerk of Courts a Motion for Discovery demanding prosecutorial evidence; obtains applicable Certifications (FST, Intoxilyzer 5000, Solution) from law enforcement; once obtained, reviews all of this evidence with client; conducts research and drafts Motion(s) to Suppress Evidence and/or In Limine and/or Motion to Dismiss Case; prepares for and/or attends Motion Hearing before the Municipal Court Judge.


Level 6 - Ms. Clark becomes counsel of record for client; personally meets with client; assesses police stop and constitutionality thereof; makes herself available to address all of client’s questions and concerns; assesses such issues as refusal to blow, field sobriety exercises (horizontal gaze nystagmus, walk and turn, one leg stand), 2255 documentation; breathalyzer examination and related components; reviews client’s history; researches applicable statutes; analyzes accompanying alleged ordinance violations; drafts and files with the Municipal Clerk of Courts a Motion for Discovery demanding prosecutorial evidence; obtains applicable Certifications (FST, Intoxilyzer 5000, Solution) from law enforcement; once obtained, reviews all of this evidence with client; conducts research and drafts Motion(s) to Suppress Evidence and/or In Limine and/or Motion to Dismiss Case; prepares for and/or attends Motion Hearing before the Municipal Court Judge; prepares for and/or represents client at Jury Trial or Bench Trial.


Fees: Ms. Clark performs legal representation up to the fee the Client agrees to pay. For example, if Client agrees to pay Ms. Clark one fee for legal representation, but only pays Ms. Clark a partial fee, Client agrees that Ms. Clark is to only provide a legal defense at the aforementioned Level (see Scope of Work).  For DUI cases in counties outside to Franklin County, such as Licking, Fairfield, Union, Delaware, Ross, Pickaway Counties, fees will increase beyond the specific agreed upon Level of representation.

Also, if, for example, Client wants legal representation at the Level 2 but has only paid for Level 1 and the next court date is within two weeks, Client agrees that Ms. Clark is to perform legal representation at the aforementioned Level 1. Client’s use of an expert witness is not included in the legal fee.
